Conditions

1- General Points
Any and all orders placed with TranslatePls.com ("The Agency") imply the full and complete acceptance of these General Sales Conditions ("GSC") by the Client. Should any contradiction arise between these GSCs and any condition or information of the Agency anywhere else on the site www.TranslatePls.com, the provisions outlined in these GSCs will prevail except by express indication of the contrary by the Agency. These GSCs may be reviewed or updated at any time, without prior notice, by the Agency. The full or partial severability of any clause of these GSCs does not render any or all other provisions void. All quotes and services fall exclusively under these GSCs. Any and all other term or condition must be subject to prior written approval by the Agency. Any special dispensation to the Client will not change these GSCs in any way.

2- Order
A quote is offered directly online according to the number of words and language of the translation. Once you have accepted the price, you can send us the document. You will then receive a confirmation email, and you must proceed immediately to online payment so as to finalize your order. Only after payment has been made will the order be processed, except by prior written approval from our Agency. Please note: if either the number of words to translate or the field of translation, or both, do not correspond to what was entered during the quote process, the order will be suspended, even if it is paid.
The client agrees to provide any documentation or information in order to help TranslatePls.com complete the work. This help specifically includes providing TranslatePls.com with specialized literature, glossaries, analogous texts, background documentation, etc.
Clients will provide reference documentation for any technical texts, thus allowing the translator to better understand and familiarize himself/herself with the company's terminology.

3- Price, Payment Methods, Penalties
Prices available for consultation on our site are calculated according to the translation field and the number of words. A minimum fee may be applied.
Word count is based on source words (from the original document to be translated provided by the Client) and is the basis for the price calculation.
Payment is made during the Order or, with prior written approval from the Agency, within 30 days net after the date of invoice. Payment may be made either by credit card (VISA, MasterCard) through PayPal, by bank transfer (bank fees are entirely your responsibility), or by French currency cheque (made to the order of 3wCommunication SARL).
If payment of invoice is not made within the terms set by our Agency, and after written notification of such, you will be charged interest on the amount due, set at current legal interest rates. Our Agency may suspend delivery in the case of late payment. Collection fees incurred are your responsibility.
For any cancellation of order by the Client, the work completed shall be invoiced at 100%, and work remaining shall be invoiced at 50%.

4- Delivery Deadline
The deadline is the one provided when the quote was calculated online. It will be communicated to you by email.

5- Liability Limitations
TranslatePls.com is only liable for the corresponding amount of invoice.
TranslatePls.com will not be held liable for delivery delays by fax, email, and other postal methods not directly controlled by TranslatePls.com.
In no way can the Agency be pursued or held liable in any capacity for complaints with respect to nuances in style or generated by the quality and nature of the source document.
The Client holds TranslatePls.com harmless against any and all appeal and/or complaint from any entity or party(ies), from the use of its services.
In no way can any flaw(s) in one part of the translation bring into question the entire translation work. TranslatePls.com reserves the right to make changes. Potential corrections must be requested by the Client and will be done after approval from TranslatePls.com. In no way will corrections done by the Client be deductible from the invoice.
Any and all complaint(s) will be considered only if it was made by registered letter with acknowledgement of receipt no later than seven (7) calendar days after delivery of work. It must contain the original documents and the contested translation. After this deadline, no complaint of any nature may be enforced against TranslatePls.com. In the case of a complaint within a pre-established deadline, TranslatePls.com agrees to deliver a new version of the contested translation, at its expense and within a limited timeframe. Final judgement on the quality of the document will be made on this new version, and TranslatePls.com has sole discretion as to the pertinence of any and all contestations, and as to the decision with respect to reimbursement.

6- Intellectual Property
Any and all distinctive signs, logos, and other elements contained on the site are the exclusive property of TranslatePls.com and are protected by intellectual property rights. They may not be used by the Client for business or marketing purposes without prior authorization from the Agency.
Authorization for the purposes of personal, non-commercial use of the Site and of the translations completed does not constitute in any way authorization to intellectual property rights or any other property rights belonging to the Agency.

7- Confidentiality
The Agency may create a file with client information, and handle said information contained therein. If such is the case, this file will be declared to the National commission for information technology and civil liberties. The Company TranslatePls.com promises to not share confidential information provided by the Client to third parties. This information will only be used by TranslatePls.com. No client list file will be sold. The Client is advised that in accordance with the Privacy Act, the Client has the right to access his or her information and make changes or deletions to personal data.
TranslatePls.com will do everything in its power, within the limitations of electronic format services, to maintain the utmost confidentiality of client documents and/or personal information; they will be used solely for translation services.

8- Applicable Law
These General Conditions are subject to French law in their interpretation and execution. Subject to mandatory legal provisions to the contrary, the Paris Commercial Court shall have sole jurisdiction over any and all contestation that may arise from this contract or its execution.
Only written agreements between the parties will be taken into consideration. Failing any such agreement between the parties, the Paris Commercial court will have sole jurisdiction.
If the General Conditions are found in several languages, only the French language version shall prevail between the parties.
